GENERAL TERMS AND CONDITIONS

These General Terms and Conditions (hereinafter referred to as "GTC") contain the general terms and conditions of use of the Webshop operated by the Service Provider detailed in Section 1 below. The Consumer (hereinafter referred to as “Consumer”) using the electronic commerce services provided by the Service Provider accepts and acknowledges the provisions of this GTC by ordering in the Webshop. Buying:

  If you want to buy something, put it in the basket! You do not need to sign in at this time. When you're done shopping and wanting to finalize, you can register or sign up without losing your basket.
  The contents of the cart can be changed at any time before the payment can be canceled.

SPECIAL OFFER:

Home delivery:

  Home delivery is provided by Express One Hungary Kft.
  You can track the package status online at http://expressone.com/.
  Any other contact information will be sent to your package by email (date, time of delivery, amount payable, etc.)

  Shipping charges in Hungary:

          For bank card payment, shipping is 1590Ft
          For prepaid payment, shipping is 1590Ft
          In case of cash on delivery, delivery is nationally: 1990Ft
  Orders are summed up every week, Tuesday, and closed. Orders received by Tuesday until 13:00 on a given week are shipped on Thursday of the same week. Orders received after Tuesday at 13:00 will be shipped with orders received until Tuesday at 13:00 on the following Thursday. On request, delivery is possible on other days of the week, but for other days or for a specific date of delivery, a surcharge of 1000 HUF / package is charged.

 Payment Terms:
    -Payment: At delivery, the courier will be paid in cash for the goods, the cash invoice will be
     included in the package.

    -Bank card payment: after the payment, we will start the package on the next delivery day of the weekly shipment.
    -Delivery Forward: After placing an order, we issue the transfer invoice. Immediately upon receipt of the amount payable to our bank account
     we will arrange the delivery of the products, the original of the invoice will be included in the package.
    -Declaration to contracted partners: After ordering, we take immediate action to deliver the products,
     the invoice is included in the package or sent to the customer by post.
         This form of payment is not automatic and can be used by our existing business partners with whom we
         separately agreed and registered with tillandsia.hu webshop and no expired account.
    In case of late payment, we charge the default interest as required by law.


Warranty:

  The warranty label is shown on the packaging per product. In all cases, the goods are delivered in accordance with the standards as well as the quality of the domestic distribution. Our product briefings contain only general guidelines. We can guarantee the stability of the quality of our products at the right level. The products sold by marczika.com are covered by the warranty rules of the Civil Code and Government Decree 151/2003. The warranty or warranty claim is enforced by the dealer or service center indicated on the warranty voucher.


Privacy protection:

  The data we provide to us are stored and kept strictly confidential. Under no circumstances will they be passed on, made available or made available to the public (except for the obligation to provide information required by statutory regulations or for the delivery of postal or courier services).

1. GENERAL INFORMATION, CONDITIONS:
1.1 Purchases from a Service Provider are made exclusively by telephone, fax, e-mail or Internet
1.2 Purchase from the Service Provider is subject to the Customer's valid registration. By registering, the Customer acknowledges at the same time that he / she is aware of this GTC and deems it binding and accepted as such.
1.3 The contract between the Parties after the completion of all mandatory fields of the ordering form and the verification of the data entered shall be made by clicking on the "Submit Order" icon. archived.
After the buyer logs in, you can view your previous orders under the Orders menu item.

2. REGISTRATION
2.1 If the Buyer is not yet registered in the tillandsia.hu webshop, you must register with the exact details before buying.

2.2 Any application form containing one or more defects shall be declared invalid and we shall not be liable in any way for any misconduct resulting from erroneous data.


3. MARKETED PRODUCTS
3.1 The characteristics of the goods offered for sale can be found in the details page of the commodity in addition to the specific commodity for online shopping.
The current purchase price, ie the gross selling price payable for the goods in the customer's turnover, including the amount of VAT and other taxes on the goods.


4. WARRANTY, WARRANTY
4.1 The warranty period is usually one year, starting with the delivery of the goods to the Buyer. The warranty claim can be enforced with a warranty voucher, which will be delivered to the Customer together with the goods. The Customer may directly enforce its claim for repair at the repair service indicated on the Warranty Ticket. Only new parts can be installed during the repair. The warranty period is extended by the duration of the repair. Additional rules of the warranty are contained in Article 151/2003 on mandatory warranty for certain durable goods. (IX.22.) Government Decree.
4.2. The Seller is responsible for the quality of the goods he sells in case of defective performance with the guarantee specified in the Civil Code, the main rules of which are as follows:
The seller fails to perform if the thing provided does not comply with the statutory or contractual properties at the time of delivery. Otherwise, it shall be presumed that the fault discovered within six months of completion has already occurred at the time of execution, unless that presumption is incompatible with the nature of the thing or the nature of the fault.
In the event of a defective performance, the claimant may, primarily, at its option, require repair or replacement, unless the performance of the chosen warranty claim is impossible or if it would result in a disproportionate additional cost to the obligor compared to the fulfillment of the other warranty claim. If the Buyer is not entitled to repair or replace, or if the Customer does not undertake the repair, replacement, the Buyer may, at his option, request a reasonable price reduction or cancel the contract. There is no place for withdrawal due to insignificant error.
The Buyer shall disclose the objections to the obligor as soon as possible after the fault has been discovered. The Buyer may exercise his warranty rights during the two-year limitation period from the date of performance. If the Buyer is unable to enforce his claim for rescuable reasons, the term for enforcing warranty rights shall be three years in the case of a durable item.
The costs related to the performance of the warranty obligation shall be borne by the Seller (obligor).
4.3. The Buyer may validate his objections at the Seller's seat:

5. ORDER AND SHIPPING
5.1 Buyer selects your order by selecting the specific product. You should also choose transport options when you place your order.
5.2 The Seller confirms the order within 48 hours at the latest. With the confirmation, the contract is created. If the confirmation is not received within 48 hours, the Buyer's bid offer will be automatically terminated.
5.3 At the time of delivery / receipt, the Buyer shall check the delivery (unopened factory packaging, warranty voucher) in batch form and, in case of complete quantity delivery, sign the receipt (invoice, delivery note). Subsequently, the Seller will not accept any quantity claims.
5.4 If the Seller delivers the goods in accordance with the provisions of the contract, it will notify the Buyer of the date of the specific delivery prior to the delivery, using the contact details provided in the order. It is the Customer's responsibility to ensure that the delivery of the package is completed within the given period, or to notify us within 24 hours prior to the delivery of the order if the date of delivery is inadequate.
5.5 If the delivery is unsuccessful during the delivery of the goods, the Seller shall notify the Seller of this fact and then attempt to deliver the goods at least once. The cost of unsuccessful delivery to the Buyer shall be borne by the Buyer.


6. METHOD AND COSTS OF TRANSPORTATION

7. LICENSE FROM SHOPPING
7.1 The buyer may withdraw from the purchase within 8 working days after receipt of the goods without justification. How to do this is set out in Article 17/1999 on distance contracts. (II.5.). The consumer may exercise the right of withdrawal from the day the goods are taken over. The product must be returned to our address in its original, undamaged condition and in unopened packaging. Our company is obliged to reimburse the full purchase price in case of return of the product without any damage, full content and packaging. Exercising the right of withdrawal does not entail any additional costs for the customer, but the customer must provide the return of the product.
At the Customer's request, we provide a discounted return delivery by our courier service, but in this case Buyer bears the costs!
7.2 In the event of Seller's withdrawal, the amount paid by the Buyer shall be repaid within 30 days. The Buyer shall bear the costs of returning the goods due to the exercise of the right of withdrawal. The Seller may claim compensation for any damage resulting from the misuse of the goods.
7.3 The Customer shall not be entitled to exercise the right of withdrawal in respect of copies of copyrighted products (such as audio or video recordings, and computer software, etc.) if the original packaging of the product is opened.


8. LIMITATION OF LIABILITY
8.1 Buying from the Service Provider via the Internet presupposes knowledge and acceptance of the possibilities and limitations of the Internet by the buyer, with particular regard to technical features and errors.
8.2. Marczika Horticulture and Trading Ltd. is not responsible for the circumstances, facts listed in the points listed below, for any reason or for any reason. followed by:
* any data sent and / or received via the Internet, other than from the Service Provider;
* any malfunction in the Internet network, which prevents the marczika.com Webshop from working and shopping;

9. PERSONAL DATA
9.1 The use / processing of personal data of the Buyer shall be in accordance with the effective regulation of the Data Protection Act. The Buyer is always entitled to disable data management.
9.2 The Service Provider stores the Customer's data in order to perform the contract and to prove the terms and conditions of the contract later, however, it is not entitled to transfer it for any other purpose without the explicit consent of the Buyer.
9.3 Unless expressly prohibited by the Buyer, the Buyer shall be permitted to use the postal address specified in the registration or at the registered address. by email for information on promotions and news.

10. COMPLAINTS PROCEDURE
Marczika Kft. informs the customer that he can submit his complaint to Marczika Kft. in writing by post or e-mail. Marczika Kft. is obliged to respond in writing to the customer's complaint recorded in writing within 30 days of receipt. If Marczika Kft. rejects the complaint, it is obliged to justify this position to the customer.
Marczika Kft. draws the customer's attention to the fact that out-of-court settlement of a dispute (Consumer Dispute) between him and Marczika Kft. and in the event of failure, a decision may be taken by the buyer's conciliation body in order to ensure the simple and effective enforcement of the buyer's rights. Marczika Kft. Informs the customer that the competent conciliation body according to its registered office is the Pest County Conciliation Body (registered office: 1119 Budapest, Etele út 59-61., 2nd floor 240). Marczika Kft. is obliged to cooperate in the conciliation board proceedings. Marczika Kft. takes minutes of the statement made by the customer. The Protocol shall contain the name, address and statement of the purchaser that he consents to the data recorded in the Protocol in accordance with the relevant 19/2014. (IV. 29.) NGM,

  •     the name and purchase price of the product sold within the framework of the Contract between the buyer and Marczika Kft.,
  •     the date of performance of the Contract by Marczika Kft.,
  •     the date of reporting the problem / error / complaint and a description of the problem / error / complaint,
  •     the right that the buyer wishes to enforce based on its warranty or guarantee claim.

The customer acknowledges and agrees that Marczika Kft. will investigate the complaint within 48 hours after its notification (which only includes the hours of working days within 48 hours) and will notify the customer of the result of the investigation by e-mail. If Marczika Kft. fulfills its warranty and / or guarantee obligations in a way different from the right to be enforced by the customer, it shall provide the customer with the reason for this. Marczika Kft. keeps the recorded minutes for three years and makes a copy of the minutes available to the customer.

OTHER PROVISIONS
The present General Terms and Conditions and its interpretation are governed by the rules of interpretation of Hungarian law and the Hungarian language. In matters not regulated in these GTC, the Civil Code and other applicable laws shall govern.
